Given that judges have such latitude in determining fairness, it may be difficult to predict in advance whether a reconciliation agreement will be implemented or not. It is essential to seek advice from an experienced family lawyer before the contract is concluded. As a general rule, a court requires that an agreement be reached in writing and signed by both parties. Both parties must have the opportunity to be represented by an independent lawyer. Both parties are also obliged to enter into the agreement on a voluntary basis and both must disclose the full financial disclosure, including associated asset returns, describing all assets, income and sources of income, as well as any debt or other financial obligations. You need to think about the key areas that your contract should cover in relation to what the other spouse needs to work for the marriage to work (and what you are willing to offer in return). It is likely that this will be reciprocity or, at the very least, a similar obligation for you. So be careful what you want! They must also take into account the “success” or “failure” of these particular obligations. How are they measured (when measured)? Will there be some kind of penalty for non-compliance (for example. B some kind of fine when the assets are later allocated)? You also need to think about what the sharing of assets and things like your income and capital needs will be in the future.

Will there be a point where the agreement could be exceeded and need to be reviewed?
